The Great Paradox

One cannot be “one,” with oneness while in the physical world, because to be here is to be involved in the illusion of separation.

In that respect the Christians may be correct. The only difference between them and modern New Age Philosophy is that they do not see the illusion for what it is.

Life is simply a process of the creator (God) “that which created us,” experiencing itself in the physical realm. It is the creator gazing into a mirror so that it can experience itself in its wholeness. It is the sum of its parts experiencing all of its parts as whole, divided, but never separated, standing in front of the mirror, experiencing itself as “being.”

During meditation or prayer, we try to bridge the gap and join with one, once more. This very act once again produces an illusion of joining with creator. We fool ourselves into this belief because it is the very first thought that separates us in the first place.

If we believe that we must meditate or prayer to join with creator then we have created the separation that we are trying to close. We are thinking or declaring that we are separated and that we have to meditate or pray to connect.

Should we know that we are separated, then we cannot join and we cannot meditate or pray to get there. What the mind conceives becomes our reality. If we think separation, we will automatically create it.

On the other hand if we are communicating with “One,” then we are joined in that moment of being connected. Because we are constantly connected in communication at some level of consciousness, then we are never separated. So it is in the physical mind of mankind “ego,” that we create the separation and the illusion.

The joining of all parts together with the mind of the “whole,” works in harmony to create an illusion of time and space. We are “one,” thinking we are separated, knowing that we are not. In truth we are God, there is no one else within the body that we call “God,” or the “Creator.” In Christian belief it would be blasphemy to call oneself “God,” because to say the word is to give reverence to it, create separation, diminish one’s power and make one inferior. To say I am God is to say that “God,” is a lesser God equal to me, when in fact it is the other way around, to say I am God is to make me equal to God and destroy the illusion of separation.

I am God, I am the sum of all my parts, and I work within the illusion of time and space which I created to know and experience myself as all that is. I am omnipresent, omnipotent, and omniscient. I am all that is and I am nothing, I am everywhere and nowhere at the same time. I am all powerful and I am powerless and it is through the experience of the illusion of your physical life that I can imagine the experience all of these things.

The illusion must be kept alive in order for me to experience life, which is what I am.

As humanity we can experience being “one,” by imagining it. By knowing that we are already one and that there is no place to go or to be. We are creating the illusion ourselves and living within it. We can know the whole by experiencing knowing that we already are what we wish to experience. By recognizing the duality within the whole experience we can experience both at the same time.

I am “God,” imagining “Me,” experiencing “myself,” through the imagined parts of the whole and the process called life. I can know myself through the physical awakening of my parts without destroying the illusion I have created.

By awakening to this truth, I destroy the fear that comes from living in the darkness which is also me. When I see it for what it is, I can only fall in love with the beauty of how it all works. I can live with the knowledge that I cannot be destroyed. I can live with the images of the world that I have created knowing that it is appropriate given the model that I have created and my relationship to it. There are no wars, unless I create them. There are no disasters unless I create them and there is no struggle unless that is what I wish to experience. I create all of these things through the cooperation of all my parts. There are no victims, because there is only me. I can only destroy the illusion by not focusing on it. And even then it will still exist in part of my memory. Each part has the same attributes and characteristics of the whole. Each part has free will to choose what it will experience and all parts are brought together in free will.

All things are happening at the same time, all experiences are probable and inevitable, and it is the experience of them that is by choice a part of the illusion.

Life is not to be feared, fear is to be experienced as is love, and neither can be experienced individually unless one focuses on one more than the other. When one part does not see the whole picture, it shuts itself off from the rest and lives in the dark and the fear. It experiences fear and separation. When one opens itself to the awareness of this eternal connection, it comes into the light and experiences the whole and moves away from fear and it is always by choice.

We are in the physical world and it is appropriate at this time, to experience the separation. But we are not of this world; we are the world, this one and the next. Life is a paradox because it was never meant to be figured out, just experienced. Expanded awareness brings opportunity to experience other probabilities, possibilities and inevitabilities.

We move within our own awareness and maturity to accept what we experience as being appropriate.

Intellectual Property - Trade Marks - Distinctive Character Test - Landmark Decision

The recent decision by the European Court of Justice (”ECJ”) in Societé des Produits Nestlé SA v Mars UK Ltd [2005], makes it easier for trade mark owners to satisfy the distinctive character test when applying for registration of their trade marks. The ECJ decided that the necessary distinctive character required for a trade mark registration can be acquired as a consequence of its use as part of another registered trade mark provided that an average, well-informed consumer would deem it to be distinctive of its trade origin.

Nestlé owns the UK registered trade marks, KIT KAT and HAVE A BREAK…HAVE A KIT KAT in class 30 in respect of chocolate, confectionary, candy and biscuits. In 1995, Nestlé applied to the UK Trade Marks Registry to register the phrase HAVE A BREAK as a separate trade mark in class 30 in respect of chocolate, confectionary, candy and biscuits. The mark HAVE A BREAK was accepted by the Trade Marks Registry and published for opposition purposes. The mark was opposed by Mars UK Limited on the grounds that the mark was devoid of distinctive character relying in particular on art 3(1)(b) of First Council Directive (EEC) 89/104 (”the Directive”) (to approximate the laws of the member states relating to trade marks).

Art (3)(1)(b) of the Directive, (as well as s3(1)(b) of the Trade Marks Act 1994) provides that trade marks devoid of distinctive character shall not be registered. An exception arises where “…before the date of application for registration and following the use which has been made of it, the mark has acquired a distinctive character (Art 3(3))”.

As a result, the opposition was upheld and Nestle’s application for registration of the mark HAVE A BREAK was rejected. Nestle appealed to the High Court. This appeal was dismissed and Nestle appealed to the Court of Appeal. The Court of Appeal had to consider:-

 Whether the expression HAVE A BREAK was devoid of inherent distinctive character under art 3(1)(b) of the Directive rendering the expression unregistrable.

 Whether registration of HAVE A BREAK might occur only on the basis of art 3(3) of the Directive, subject to proof of distinctive character acquired through use i.e. whether the mark HAVE A BREAK had acquired distinctiveness through the use of the mark HAVE A BREAK…HAVE A KIT KAT. This meant that if the mark had acquired distinctiveness as a result of its use, then it would be registrable.

 The Court of Appeal highlighted that the application had been rejected on the ground that the phrase HAVE A BREAK was essentially used as part of the registered mark HAVE A BREAK…HAVE A KIT KAT and not, genuinely, as an independent trade mark.

 Nestle’s submission that this decision could have serious consequences for trade mark owners seeking to register marks comprising shapes since such marks were seldom used by themselves, and considered that a slogan-like phrase associated with a trade mark might, by repetition over time, create a separate and independent impression and thus acquire distinctive character through use.

 As a result, the Court of Appeal decided to stay proceedings and refer to the Court of Justice of the European Communities for preliminary ruling the question whether the distinctive character of a mark referred to in art 3(3) of the Directive might be acquired following or in consequence of the use of that mark as part of or in conjunction with another mark.

The ECJ ruled:

 The distinctive character of a mark referred to in art 3(3) of the Directive might be acquired in consequence of the use of that mark as part of or in conjunction with a registered trade mark.

 Whether inherent or acquired through use, distinctive character had to be assessed in relation, on the one hand, to the goods or services in respect of which registration was applied for and, on the other, to the presumed expectations of an average consumer of the category of goods or services in question, who was reasonably well-informed and reasonably observant and circumspect.

 In relation to acquisition of distinctive character through use, the identification, by the relevant class of persons, of the product or service as originating from a given undertaking had to be as a result of the use of the mark as a trade mark. In order for the latter condition, which was a central issue in this case, to be satisfied, the mark in respect of which registration was sought need not necessarily have been used independently.

 Art 3(3) of the Directive contained no restriction in that regard, referring solely to the ‘use which has been made’ of the mark. The expression ‘use of the mark as a trade mark’ had therefore to be understood as referring solely to the use of the mark for the purposes of the identification, by the relevant class of persons, of the product or service as originating from a given undertaking. Such identification, and thus acquisition of distinctive character, might be as a result both of the use, as part of a registered trade mark, of a component and of the use of a separate mark in conjunction with a registered trade mark.

 In both cases it was sufficient that, in consequence of such use, the relevant class of persons actually perceived the product or service, designated exclusively by the mark applied for, as originating from a given undertaking.

Comment:

 The main points arising from the decision that trade mark owners should be aware of are:

o A mark could acquire the necessary distinctive character when used as part of another phrase or trade mark;

o Distinctive character must be assessed in relation to the goods and services concerned and the presumed expectations of an average, well-informed consumer;

o Art 3(3) contains no restriction on the way in which any mark has gained its distinctive character; and

o It is therefore possible for this distinctive nature to be achieved through the use of the phrase HAVE A BREAK as part of the larger mark HAVE A BREAK…HAVE A KIT KAT.

 The decision must be applied to the facts by the Court of Appeal. However, the ECJ has made it clear that there is no requirement for a mark to be used independently in order for it to obtain a sufficient level of distinctive character to be registered as a trade mark.

 This decision has completely changed the English court’s approach to the question of distinctiveness when marks are used together. The English court’s approach was problematic for owners of non-conventional marks such as slogans, shapes or colours which are rarely used on their own. Use of the combination will now be taken into account when judging whether any individual element is registrable. This decision will be applied in all European Union Countries.

Payday Loan Companies

At one point or another everyone of has encountered this situation, not having enough money to make it to our next payday. A common solution to this problem that seems to becoming more popular is a payday loan. While a payday loan may be fast and convenient, it may not be the best solution.

A payday loan company offers to loan you money based upon repaying it and a service fee on your next payday. This often seems like a perfect solution until you look closer.

There is a simple reason as to why we are seeing more payday loan companies opening up and advertising so much. Payday loans are very profitable for those doing the lending due to the high interest rates and often end up being almost addictive for those borrowing the money. A recent national survey of payday loan companies found that only 37% of companies accurately reflected their interest rate. At most places the interest rates varied from 390% to 851% annually with the average being 474%.

Once you get into a payday loan agreement it is often hard to get out of it due to the amount that must be repaid at once. In fact 77% of people who borrow money from a payday loan company can not afford to repay it in full so they roll the loan. When your loan is rolled a portion of the total amount owed is paid and the remaining amount of the old balance, including the old service fees, plus the new service fees and interest rates are added on to a new loan. Obviously it is very difficult to pay down the loan when so much more is being added on to what is owed.

If you can not afford to repay any of your loan then you may receive an even bigger surprise than the interest rates. It is common practice for you to sign a wage agreement that allows the payday loan company to garnish as much of your pay as they wish without having to go to court. Another option available to most companies is charging you with fraud. In many areas it is fraud to write a check if you do not have the money in your account to cover the check and you may receive court order fines or even some jail time.

If you find yourself in a situation where you need to borrow from a payday loan company then perhaps it is time to pause and reflect upon how you got to this point. Sometimes situations arise that you have no power over but more often it is a fault of bad financial planning. Now would be a good time to review your monthly budget and try to see what went wrong and what you can do to prevent the problem from occurring again.

Depending upon your situation, there may be better options for you than a payday loan. For example, if you have a little time to wait, you may be able to use funds in your 401K plan. Funds withdrawn from your 401K you are only taxed at 10% and if you make arrangements with your payroll department to repay the withdrawal from your 401K then it is not taxable at all.

Before getting a payday loan make sure you have examined all of your options. Do you really need this loan? Is there a mistake on your credit report preventing you from getting a normal loan or credit card? Can you change your monthly budget to avoid the financial problem you are experiencing? Payday loans may seem like a convenient option but a steep price comes with that convenience.

Here’s some ways to hold on to that cash:

1. Consider booking a hotel just outside the city.

Brookline and Cambridge are two nice cities that come to mind.
You can easily hop on the “T” for a short ride and take it into
Boston and back each day. You can save a large chunk of change
depending on how long you are staying on your trip.

2. Check out the prices of flights arriving into Providence.

It is only a 50-minute bus ride to Boston. Southwest Airlines,
which can offer significantly lower rates, does not fly directly
into Boston so what you’ll lose in convenience, you’ll gain in
savings.

3. Book a package deal.

Websites such as Orbitz.com, Hotels.com, Expedia.com, and
Travelocity.com all offer packages that will save you money by
purchasing air and hotel together. You may even want to check
directly with the hotel to see if they are offering a lower rate
than advertised online.

4. Stay at a local B&B or rent a furnished apartment.

Normally, they end up being cheaper and give you a better feel of what living in Boston is really like. Two companies that offer many prime Boston locations are The Bed and Breakfast Agency of Boston (http://www.boston-bnbagency.com/) and The Bed and Breakfast Associates Bay Colony (http://www.bnbboston.com/).

5. Ride the MBTA (also known as the “T”).

This is the subway and bus system that covers all of Boston.
Driving and parking in Boston can be frustrating and expensive.
If you plan on seeing many sights, you can pick up a visitor pass for a flat fee of $7.50 for one day, $18 for three days, or $35 for seven days. Most rides are $1.25 otherwise.

6. Buy a Boston CityPass (http://www.citypass.com/).

This allows you to see six of Boston’s most famous attractions
for 50% off the price and avoid the ticket lines. You can
purchase this pass online or at the first attraction you visit
for $36.75 for adults and $25.50 for youths. These include the
Museum of Science, New England Aquarium, Skywalk Observatory,
Museum of Fine Arts, Harvard Museum of Natural History, and the
JFK Library & Museum.

7. Spend time at the free attractions.

You can enjoy the street performers and browse the shops at
Quincy Market. Go for a walk on the Freedom Trail. Spend time
in Boston Common, the oldest US park. Ride its famous swan boats for under three dollars. Go to the Harvard University Art
Museums on Saturdays from 10 AM to 12 Noon to receive free
admission. Other museums offer specials as well so check their
websites.

8. Use coupons.

Check with your travel company or with the hotel you are staying
at for specials and coupons. When I booked my trip to Las
Vegas through Expedia.com, I was given a booklet at my hotel with numerous discounts throughout the city. If you are a member of AAA, give them a call to see what deals they offer. You can even check an attractions main website.
